These Terms & Conditions (“Terms”) govern access to and use of BetterMouth.TV (“Service”), operated by State & Lake Marketing, Inc. (“Company,” “we,” “us,” or “our”). By subscribing to or using the Service, you (“Customer,” “Practice,” or “you”) agree to be bound by these Terms.

1. Service Description

BetterMouth.TV is a subscription-based patient education platform designed for dental offices. The Service provides access to a curated library of dental educational video content created specifically for BetterMouth.TV and intended solely for in-office patient education via compatible display hardware.

2. License Grant & Permitted Use

Subject to these Terms and an active subscription, we grant you a limited, non-exclusive, non-transferable, revocable license to display the licensed BetterMouth.TV content only within your physical dental office location(s) for patient education purposes.

Permitted Use Includes:

• Displaying BetterMouth.TV content in waiting rooms or treatment areas
• Using content solely during the subscription period
• Using content only via the BetterMouth.TV platform and approved integrations
  

3. Prohibited Use

You may not:

• Download, copy, record, distribute, modify, or reproduce any content
• Use content outside of your physical office (including websites, social media, ads, email, or internal training)
• Share access credentials with non-authorized parties
• Resell, sublicense, or commercially exploit the content
• Use the content in a way that implies endorsement, sponsorship, or affiliation beyond the Service itself
  

4. Content Ownership & Intellectual Property

All BetterMouth.TV content, including videos, scripts, graphics, trademarks, and branding, is owned exclusively by State & Lake Marketing, Inc. or its licensors.

Nothing in these Terms transfers ownership of any intellectual property to you.

5. No Endorsement Disclaimer

The Service does not constitute an endorsement of any dental office, product, treatment, or clinical outcome by Whitney DiFoggio, Teeth Talk Girl, or any affiliated brands.

Use of BetterMouth.TV does not grant rights to use Whitney DiFoggio’s name, likeness, image, or personal brand in marketing or promotional materials.

6. Hardware & Amazon Signage Stick Disclaimer

BetterMouth.TV subscriptions may include the use of Amazon-manufactured signage or streaming sticks (“Devices”).

• Devices are not sold to you; they are leased solely for the purpose of accessing BetterMouth.TV
• Title and ownership of all Devices remain with the Company or its suppliers
• Amazon is not affiliated with, endorsing, or sponsoring BetterMouth.TV
• We make no warranties on behalf of Amazon regarding the Devices
• Devices may only be used with BetterMouth.TV and may not be repurposed
  
  

Failure to return leased Devices upon termination may result in replacement fees.

7. Third-Party Services

BetterMouth.TV integrates with third-party platforms, including but not limited to:

• OptiSigns – for content management and display
  
  
• Stripe – for subscription billing and payment processing
  
  

We are not responsible for service interruptions, outages, or failures caused by third-party providers. Your use of these services is subject to their respective terms and policies.

8. Subscription, Billing & Payments

• Subscriptions are billed monthly unless otherwise agreed in writing
• Payments are processed securely via Stripe
• Fees are non-refundable except where required by law
• We reserve the right to suspend or terminate access for failed or delinquent payments
  
  

Pricing may change with prior notice.

9. Cancellation & Termination

You may cancel your subscription at any time. Access will remain active through the end of the current billing period.

We reserve the right to suspend or terminate access immediately for:

• Violation of these Terms
• Unauthorized use or distribution of content
• Misuse of leased Devices
  
  

Upon termination, all licenses granted herein immediately cease.

10. No Medical Advice Disclaimer

BetterMouth.TV content is for general educational purposes only and is not medical advice. Content does not replace professional diagnosis, treatment, or clinical judgment.

Dental offices remain solely responsible for patient care decisions.

11. Limitation of Liability

To the maximum extent permitted by law, State & Lake Marketing, Inc. shall not be liable for any indirect, incidental, consequential, or punitive damages arising from use of the Service.

Our total liability shall not exceed the amount paid by you for the Service in the prior 12 months.

12. Indemnification

You agree to indemnify and hold harmless State & Lake Marketing, Inc., its officers, employees, contractors, and affiliates from any claims arising out of:

• Your misuse of the Service
• Violation of these Terms
• Unauthorized content use
  

13. Governing Law

These Terms are governed by the laws of the State of Illinois, without regard to conflict of law principles.

14. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after updates constitutes acceptance of the revised Terms.
